Tripcatcher is a service offered by Crunch, provided by Tripcatcher Ltd (a third party), whereby you input your mileage expenses into Tripcatcher and these are then automatically uploaded into your online Crunch accounting records (“Crunch Account”). 1. The Contract
1.1 When you use Tripcatcher you enter into a legally binding agreement with Crunch governed by the Crunch Terms of Service (which are expressly incorporated into this Contract with you) and by this Service Description to the extent that it varies or adds to them. References to capitalised terms used in this document shall have the same meaning and effect as those defined in the Crunch Terms of Service, unless expressly stated otherwise.
1.2 Unless we agree with you in writing to the contrary, you are bound by the Crunch Terms of Service and this Service Description (jointly referred to as the “Terms” in the remainder of this document) when you use Tripcatcher.
2. Accepting the Terms
2.1 When you start using Tripcatcher, you will be deemed to have accepted the Terms. Once you use Tripcatcher you are bound by the Terms until you terminate your relationship with Crunch.
3. Provision of Tripcatcher Services by Crunch
3.1 Crunch enables use of Tripcatcher through Tripcatcher Ltd. Tripcatcher Ltd may change Tripcatcher or add new features in the future. By agreeing to the Terms, you acknowledge and agree that the form and nature of the Tripcatcher may change without prior notice to you.
3.2 You acknowledge and agree that Crunch may suspend or discontinue Tripcatcher, without prior notice to you and at the sole discretion of Crunch, making Tripcatcher unavailable to you or other users. If Crunch deems it necessary to discontinue Tripcatcher, you will receive at least 7 days notice before Tripcatcher is removed from your Crunch Account. You are not required to inform Crunch if you stop using Tripcatcher and you may stop using Tripcatcher at any time.
3.3 You acknowledge and agree that Tripcatcher is not an accounting service and, whilst we strive to attain extremely high levels of accuracy, we cannot guarantee the accuracy or correctness of the information uploaded into your Crunch Account.
3.4 You agree only to access (or try to access) and use Tripcatcher through interfaces provided by Crunch. You shall not access (or try to access) and use Tripcatcher through any automated means including, but not limited to, scripts, robots, or web crawlers.
4. Tripcatcher Service Features – Use and Limitations
4.1 In order to use the “web app” version of Tripcatcher, you must have internet access and the latest version of your internet browser. Tripcatcher also offers Android and iOS mobile apps that you can download and use once you have created your Tripcatcher account via Subscription. The iOS mobile app requires iOS 7.0 or later. It is compatible with iPhone, iPad, and iPod touch. The Android mobile app requires Android 4.0 or later. The Software Requirements will change, without notice, and you may, periodically, be required to obtain software or hardware updates in order to continue to use Tripcatcher.
4.2 You acknowledge that meeting the System Requirements is your responsibility.
4.3 You agree to use Tripcatcher only for purposes that are permitted both by the Terms and by any applicable law, regulation, or generally accepted practices or guidelines in relevant jurisdictions.
4.4 You agree not to amend Tripcatcher or use it for anything other than as described in the Terms.
4.5 You agree only to use the Tripcatcher for the purpose of inputting mileage claims.
4.6 If you also decide to make use of the Android or iOS app versions of Tripcatcher, you acknowledge that your agreement with your respective mobile provider will continue to apply for the duration of any data connection whilst using Tripcatcher and that you may be charged for Tripcatcher by your mobile provider. You accept responsibility for any such charges. If you are not the bill-payer, you are assumed to have permission from the bill payer for using the Android or iOS app versions of Tripcatcher..
4.7 In order to make Tripcatcher’s mileage calculations accurate please ensure you record the number of miles you had already claimed for the previous and the current tax year – 6th April to 5th April in Tripcatcher under “Miles already recorded this tax year’’ when you first download it. You are responsible for maintaining this record, which could become misstated if Tripcatcher is not used and mileage is added directly into your Crunch Account.
5. Fees and Payment Terms
5.1 Crunch will not charge you for the use of Tripcatcher.
6. Cancellation and Termination
6.1 You are able to cancel Tripcatcher by deactivating it in your Crunch Account.
6.2 Crunch may terminate Tripcatcher on any of the grounds set out in the Terms, if Tripcatcher is no longer being made available to Crunch or where it is no longer commercially viable.
